Indiana Brain and Spinal Cord Injury Lawyer – FAQs

Personal injury law is based on the idea that if one person causes harm to another, the victim is entitled to some form of compensation. Although many people are injured each year due to the negligence of others, many do not seek compensation because they are unaware that they have a claim. To help current and potential clients, the attorneys from The Hastings Law Firm have provided answers to some of the most frequently asked questions about personal injury lawsuits. In addition to claims involving fire/explosion accidents, burn injuries, wrongful death, trucking accidents, and defective products, our Indianapolis, Indiana, firm handles brain and spinal cord injury cases, and a wide range of additional personal injury matters. A lawyer can provide more information and expand upon the answers to these questions and others during a free consultation.

How much will it cost me to hire a lawyer?

The attorneys at The Hastings Law firm are paid only on a contingency basis. This means that if our clients do not receive any financial compensation from their case, neither do we

I’ve been injured - do I have a case?

What if my injury was partly my fault?

Even if you were partly at fault for your injury, you may still have a case if someone else was also at fault. Most Indiana negligence cases are governed by the law of “comparative fault”. Comparative fault provides that an injured party that is as much as 50% at fault can still recover a percentage of their damages. Comparative fault will be explained in more detail during your initial consultation.

What do I need to do during a personal injury lawsuit?

The Hastings Law Firm attorneys work closely with our clients. The client needs to be available to answer questions concerning the facts of the case and the injury, as well as to update the attorney as to their ongoing treatment. If a case proceeds to a lawsuit, a client will need to assist their attorney in answering written discovery and may need to attend a deposition, mediation and a trial. The client’s duties will be fully explained at the initial consultation.

What kind of compensation can I expect to receive?

Each case is different, and it is very difficult to determine how much compensation victims can expect. Accident victims may seek recovery of damages such as medical bills, lost wages, pain and suffering and decreased quality of life. Because there are many factors that can affect the amount of damages received in a settlement or awarded by a jury, The Hastings Law Firm does not make any representations that a certain amount will be recovered. We work hard to maximize the value of each claim, but it is impossible to predict the amount that will be recovered in any injury case.

What if I was injured at work?

If you were injured at work, you are probably entitled to worker’s compensation. You may also have a negligence claim if your injury was caused by someone other than your employer or co-employee.

The Hastings Law Firm handles third-party claims against negligent parties in workplace injuries such as a construction accident. If you were injured in a construction accident, you may have a claim against the general contractor, a sub-contractor or another third-party. The Hastings Law Firm can protect your rights and help you obtain the compensation you deserve.

How soon do I need to file a lawsuit?

The statute of limitations for most injury cases in Indiana is two years. In cases against the State of Indiana, notices of tort claim must be filed within 180 days and for cases against cities, towns, schools and other governmental entities, notice of tort claim must be filed within 270 days. The best way to avoid a statute of limitations problem is to contact an attorney as soon as possible.

Does the lawyer I hire need to be in my city or town?

It is not necessary. However, it is recommended that a client hire an attorney that is admitted to practice in the state where the injury occurred. Although the majority of our cases arise from injuries that occurred in Indiana, we have represented brain and spinal cord injury, construction and trucking accident, fire/explosion, and other personal injury victims from other states. A lawyer from our office can provide information for or a referral to an attorney in another state.
